These Terms and Conditions ("Terms") govern your use of the website myfalconpest.com and the pest control services provided by Mountain Supply LLC DBA Falcon Pest Control ("Falcon Pest Control," "we," "us," or "our"). By accessing our website or engaging our services, you agree to be bound by these Terms.

1. Services

Falcon Pest Control provides residential and commercial pest control services and is licensed by the Utah Department of Agriculture and Food to operate throughout the State of Utah. All services are performed by licensed and insured technicians in accordance with applicable federal and Utah pesticide regulations. Service availability for any specific location is determined at the time of inquiry.

2. Service Agreements

Specific pest control services, pricing, service frequency, and terms will be outlined in a separate service agreement or quote provided to you prior to the commencement of services. These Terms apply in addition to any service-specific agreement.

3. Scheduling and Access

  • We will provide appointment reminders via SMS and/or email prior to scheduled services.
  • You agree to provide reasonable access to your property for scheduled pest control treatments.
  • We appreciate at least 24 hours notice for cancellations or rescheduling so we can offer the slot to another customer.
  • Repeated access issues, late cancellations, or no-shows may result in a rescheduling or service fee. We will always communicate any fee to you in advance before charging.

4. Payment Terms

  • Payment is due upon completion of service unless otherwise specified in your service agreement.
  • We accept credit/debit cards and other payment methods as indicated on your invoice.
  • Late payments may be subject to a late fee as outlined in your service agreement.
  • Payments are processed securely through Stripe. We do not store your full payment card details.

5. Warranties and Guarantees

Service guarantees and callback policies vary by service plan and are detailed in your individual service agreement. Falcon Pest Control stands behind the quality of its work and will address pest issues between scheduled services as outlined in your plan.

6. Auto-Renewal of Service Plans

Recurring service plans automatically renew on a month-to-month basis until you cancel. Your plan will continue to bill and schedule on its stated cadence indefinitely until we receive a cancellation notice from you in accordance with Section 16 (Termination) and the cancellation provisions of your service agreement. No additional consent or signature is required for continued service after the initial term.

You may cancel at any time by contacting us by phone, text, or email. Cancellation is effective at the end of your current billing period (or as otherwise specified in your service agreement).

7. SMS/Text Message Communications

By providing your phone number and opting in to receive text messages from Falcon Pest Control, you agree to the following:

  • You consent to receive service-related SMS messages including appointment reminders, on-my-way alerts, pre-service surveys, service confirmations, and billing notifications.
  • Message frequency varies; typically 2–4 messages per scheduled service, not to exceed 10 messages per month.
  • Message and data rates may apply. Carriers are not liable for delayed or undelivered messages.
  • You may opt out at any time by replying STOP to any message.

  • Consent to receive SMS messages is not a condition of purchasing any goods or services from Falcon Pest Control.

8. Customer Responsibilities

  • You agree to follow all pre-service preparation instructions provided by Falcon Pest Control.
  • You are responsible for informing us of any pets, children, or special health considerations at the service location.
  • You agree to provide accurate contact information and service address details.
  • You agree to promptly report any pest activity between services so we can address concerns effectively.

9. Pesticide Sensitivity Disclosure

You represent that you have disclosed to Falcon Pest Control any known pesticide sensitivities, asthma, respiratory conditions, chemical allergies, pregnancy, or other relevant health conditions of any occupant, employee, or regular visitor of the service location prior to the commencement of services. You agree to update this disclosure if circumstances change. Failure to disclose relieves Falcon Pest Control of liability for any reaction or condition attributable to pesticide exposure where reasonable accommodation could have otherwise been made.

10. Re-Entry Intervals and Post-Service Safety

You agree to observe all post-application restricted entry intervals ("REIs") stated on product labels, posted notices, or communicated verbally or in writing by your technician. Re-entry intervals exist to protect occupants, pets, and property and are non-negotiable safety requirements set by the U.S. Environmental Protection Agency and the product manufacturer. You agree to keep children, pets, and unprotected adults out of treated areas for the duration of any stated REI.

11. Customer Indemnification

You agree to indemnify, defend, and hold harmless Falcon Pest Control, its owners, officers, employees, technicians, and contractors from and against any claims, damages, liabilities, costs, or expenses (including reasonable attorneys' fees) arising out of or related to: (a) your failure to follow pre-service preparation, post-service, or re-entry instructions; (b) your failure to disclose pre-existing pest conditions, structural conditions, sanitation issues, or health conditions as required under Sections 8 and 9; (c) inaccurate information provided to us about the service location, occupants, or property conditions; or (d) injury or damage caused by occupants, pets, or third parties accessing treated areas in violation of stated REIs.

12. Limitation of Liability

Falcon Pest Control's liability for any claim arising from our services shall not exceed the amount paid for the specific service giving rise to the claim. We are not liable for: pest damage that occurred prior to the commencement of our services; infestations caused by conditions outside our control (including structural deficiencies, water intrusion, sanitation issues, or external pest pressure); or consequential, incidental, indirect, or punitive damages of any kind. Nothing in these Terms limits rights you may have under applicable Utah consumer protection law.

13. Property and Safety

All pesticide applications are performed in compliance with federal EPA regulations and the Utah Pesticide Control Rule (Utah Administrative Code R68-7), including the recordkeeping requirements of R68-7-16. Safety Data Sheets (SDS) and detailed chemical application records are maintained and available upon request.

14. Photography and Marketing Use

As part of our standard service documentation, Falcon Pest Control may photograph treatment sites, bait stations, pest evidence, and related conditions before, during, and after service. These photographs become part of your service file and may be used in our customer portal, internal training, quality assurance, regulatory recordkeeping, and limited marketing materials including our website, case studies, and social media posts.

Photographs used for marketing do not identify you, your address, your name, or other identifying details unless we obtain your separate written consent. We may use exterior structure shots, interior treatment areas, pest evidence, and station condition photos in a way that does not personally identify you.

If you do not want any photographs from your property used for marketing purposes, you may opt out at any time by notifying us in writing (email is sufficient). The opt-out is prospective and does not require us to remove materials already published prior to your notice, though we will use reasonable efforts to do so on request.

15. Intellectual Property

All content on myfalconpest.com — including text, graphics, logos, photographs, and images — is the property of Falcon Pest Control and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from our content without written permission.

16. Customer Portal

Access to the Falcon Pest Control customer portal is provided as a convenience to active customers. You are responsible for maintaining the confidentiality of your login credentials. We reserve the right to suspend portal access for inactive accounts or misuse.

17. Termination

Either party may terminate a service agreement as outlined in the specific terms of that agreement. Falcon Pest Control reserves the right to discontinue services for non-payment, denied property access, unsafe conditions, or material breach of these Terms.

18. Force Majeure

Falcon Pest Control shall not be liable for any failure or delay in performance caused by events beyond our reasonable control, including but not limited to: acts of God, severe weather, fire, flood, earthquake, pandemic, disease outbreak, governmental action, supply-chain disruption, product unavailability, labor disputes, utility failure, or unsafe site conditions. Where performance is prevented or delayed by such an event, our obligations are suspended for the duration of the event and we will resume service as soon as reasonably practicable.

19. Arbitration and Class Action Waiver

Please read this section carefully — it affects your legal rights.

Any dispute, claim, or controversy arising out of or relating to these Terms, our services, or the relationship between you and Falcon Pest Control (including the validity, scope, or enforceability of this arbitration provision) shall be resolved by binding individual arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules then in effect. The arbitration shall take place in Salt Lake County or Utah County, Utah, unless the parties otherwise agree. Judgment on the award may be entered in any court of competent jurisdiction.

Class action waiver. You and Falcon Pest Control each agree that any dispute will be brought only in your or our individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding. The arbitrator may not consolidate more than one person's claims and may not preside over any form of class or representative proceeding.

Small-claims carve-out. Either party may bring an individual action in small-claims court in Utah County or Salt Lake County for any dispute that qualifies, in lieu of arbitration.

30-day opt-out. You may opt out of this arbitration provision by sending written notice to trent@myfalconpest.com within thirty (30) days of first agreeing to these Terms. Opting out of arbitration does not affect any other provision of these Terms.

20. Severability and Entire Agreement

If any provision of these Terms is found to be unenforceable or invalid by a court or arbitrator of competent jurisdiction, that provision shall be enforced to the maximum extent permissible, and the remaining provisions of these Terms shall remain in full force and effect.

These Terms, together with your specific service agreement and our Privacy Policy, constitute the entire agreement between you and Falcon Pest Control with respect to the subject matter hereof, and supersede all prior or contemporaneous understandings, agreements, or representations, whether written or oral.

21. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Utah, without regard to its conflict-of-law provisions. Subject to Section 19 (Arbitration), any disputes not subject to arbitration shall be resolved in the courts of Salt Lake County, Utah.

22. Privacy

Our collection, use, and disclosure of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

23. Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated effective date. Continued use of our website or services after changes constitutes acceptance of the revised Terms.
